Adding some some digital downloads still asks for shipping

When i select some images for digital download it is still requiring a shipping amount.  Other images do not do this, seems hit or miss.

In the past if your cart only contained digital downloads it would not even have a shipping option which makes sense as the delivery is electronic.  the moment you added at least one print then it would include the shipping option.
